General Terms and Conditions of Kröpfel GmbH

§ 1 Scope of application

1. The business relationship between us, Kröpfel GmbH, and you, the purchaser of the products (hereinafter referred to as “goods” or “items”) presented on the website http://www.kroepfel.at and http://www.kroepfel.at (hereinafter referred to as “kroepfel.at and kroepfel.com”) shall be governed exclusively by the following General Terms and Conditions (hereinafter referred to as “GTC”) in the version valid at the time of the order.

§ 2 Conclusion of contract

1. the presentation of goods via kroepfel.at or kroepfel.com does not constitute a binding offer to conclude a purchase contract.

2. only persons of legal age may order.

3. you can order the goods via the input field at http://www. kroepfel.at / http://www. kroepfel.com.

Unfortunately, we cannot accept orders that are not placed using the ordering procedure provided. When ordering via the input field, you can view your entries directly on the order form during the entire input process. You can correct input errors using the usual keyboard and mouse functions until you click on the “Order” button.

4. by placing your order by clicking on the “order” button below the input field on kroepfel.at, you submit a binding offer to purchase.

5. after receipt of an order via input form, we will immediately send you a confirmation of receipt by e-mail, which documents your order again. This confirmation of receipt merely confirms that we have received your order, but does not constitute acceptance of your offer.

6. the contract with us only comes into effect when we have sent you the

§ 4 Retention of title

The goods shall remain our property until they have been paid for in full.

§ 5 Delivery
1. the goods are shipped with Hermes or DHL. Unless expressly agreed otherwise, we shall determine the mode of shipment and the transport company at our reasonable discretion.
2. unless other delivery times have been agreed, the delivery time is up to ten working days from receipt of payment.
3. we reserve the right that the packaging of the goods may differ from the images in the store. Used shipping packaging can be used.

§ 6 Prices / shipping costs
1. the prices stated at http://www. kroepfel.at or kroepfel.com at the time of sending your order shall apply to your order.
2. all prices quoted at http://www. kroepfel.at or kroepfel.com include statutory value-added tax and do not include shipping costs.
3. the shipping costs within Austria are € 4.20. From an order value of €75, delivery within Austria is free of charge. The shipping costs to Germany are € 10,00. § 7 Terms of payment, means of payment

3. orders for which no payment has been received 2 weeks after the order date will be canceled and cannot be reactivated. After canceling an order, you must place a new order if you wish to purchase the desired items.

§ 8 Warranty and liability
1. unless otherwise regulated below, we shall be liable for material defects and defects of title in accordance with the applicable statutory provisions, in particular §§ 434 et seq. BGB. The limitation period for statutory claims for defects is two years. The limitation period begins with the delivery of the goods.

3. we shall only be liable for slight negligence if material obligations, i.e. obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance you regularly rely and may rely, are violated. In the event of a breach of such obligations, our liability shall be limited to such damages as could typically be expected to occur under the contract in question. We hold the copyright to all images, films and texts published on kroepfel.at and kroepfel.com. Use of the images, films and texts is not permitted without our express written consent.

§ 10 Final provisions
1. if you are an entrepreneur, Austrian law shall apply to orders and all disputes arising from or in connection with orders, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
2. if you are an entrepreneur, the exclusive place of jurisdiction for disputes arising from or in connection with your order shall be Wels; however, we shall also be entitled to bring an action at your registered office and at any other permissible place of jurisdiction. Otherwise, the place of jurisdiction shall be determined in accordance with the general statutory provisions.
